NOTICE OF INTENT TO REQUEST RELEASE OF FUNDS TOWN OF ORANGE On or about January 6, 2026, the Town of Orange will submit a request to the Commonwealth of Massachusetts for the release of Town of Orange Community Development Funds under Title I of the Housing and Community Development Act of 1974 (PL93-383) as amended, to undertake the following projects: O Orange Housing Rehabilitation Program ($210,000): A project for the purpose of providing technical assistance and deferred payment loans to rehabilitate distressed properties owned by eligible low and moderate income owner-occupied, single, or multi-family properties located in the town of Orange. The goal of the program is to rehabilitate to code at least 3 housing units. O Orange Wheeler Memorial Library Roof Replacement Project ($325,920): The proposed project will repair and replace the roof of the Wheeler Memorial Library located in the heart of Orange, MA at 75 East Main Street. The library is a 2-story solid brick masonry structure with steel framing that was constructed circa 1912. The upper roof system is a low-sloped roof with a rubber membrane. The asphalt-shingled sloped roof sections begin at the outer edges of the low-sloped, upper roof and terminate at the eaves and balustrade at the top of the second floor. All layers of the low-sloped roof system will be removed down to sound decking and be replaced with in-kind materials. The proposed activity is categorically excluded under HUD regulations at 24 CFR Part 58 from National Environmental Policy Act (NEPA) requirements. All comments received by 3:00 pm Monday, January 5, 2026, will be considered by the Town of Orange prior to authorizing submission of a request for release of funds. RELEASE OF FUNDS The Town of Orange certifies to the Commonwealth of Massachusetts, Executive Office of Housing and Livable Communities, that Matthew Fortier, in their capacity as Environmental Certifying Officer for the Town of Orange, consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. The Commonwealth of Massachusetts approval of the certification satisfies its responsibilities under NEPA and related laws and authorities and allows the Town of Orange to use Program funds. OBJECTIONS TO RELEASE OF FUNDS The Commonwealth of Massachusetts will accept objections to its release of funds and the Town of Orange's certification for a period of fifteen days following the anticipated submission date or its actual receipt of the request (whichever is later) only if they are on one of the following bases: (a) the certification was not executed by the Certifying Officer of the Town of Orange; (b) the Town of Orange has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR Part 58; (c) the grant recipient or other participants in the development process have committed funds, incurred costs or undertaken activities not authorized by 24 CFR Part 58 before approval of a release of funds by the Commonwealth of Massachusetts; or (d) another Federal Agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality. Objections must be prepared and submitted in accordance with the required procedures (24 CFR Part 58, Sec. 58.76) and shall be addressed to Community Development Fund Program, Executive Office of Housing and Livable Communities at 100 Cambridge Street, Suite 300, Boston, MA 02114.
